The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the legal provisions (DSGVO, TKG 2003). In this data protection information, we inform you about the most important aspects of data processing within the scope of our website.

We, GERLACH Attorneys at Law (Dr. Roland Gerlach, Mag. Michaela Gerlach, independent attorneys at law) collect, process and use your personal data only with your consent or mandate or order for the purposes agreed with you or if there is another legal basis in accordance with the GDPR; this in compliance with the provisions of data protection and civil law.
We only collect personal data that is necessary for the performance and processing of our legal services or that you have voluntarily provided to us.

Personal data is all data that contains individual information about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photographs, voice recordings of persons, and biometric data such as fingerprints. Sensitive data, such as health data or data in connection with criminal proceedings, may also be included.

Data processing in the course of the mandate relationship also includes personal data of potential opponents, persons involved and persons providing information. Pursuant to Art. 14 (5) DSGVO, there is no obligation to inform this group of persons about the processing.


2. information and deletion

As a client (including contact person) or, more generally, as a data subject, you have the right at any time - subject to the lawyer's duty of confidentiality - to obtain information about your stored personal data, their origin and recipients and the purpose of the data processing, as well as the right to rectification, data transmission, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data.

If there are any changes to your personal data, please inform us accordingly.

You have the right at any time to revoke any consent given for the use of your personal data. Your request for information, cancellation, rectification, objection and/or data transfer, in the latter case, provided that it does not involve a disproportionate effort, may be addressed to the address of the Law Firm indicated in point 10 of this statement.

If you are of the opinion that the processing of your personal data by us violates applicable data protection law or that your data protection rights have been violated in some other way, you have the option of complaining to the competent supervisory authority. In Austria, the data protection authority is responsible for this.


3. data security

Your personal data is protected by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, illegal or even accidental access, processing, loss, use and manipulation.

Notwithstanding efforts to maintain a reasonably high level of due diligence at all times, it cannot be excluded that information you disclose to us via the Internet may be viewed and used by others.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacking attack on email account or telephone, interception of faxes).


4. use of the data

We will not process the data provided to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. This excludes the use for statistical purposes, provided that the data provided has been anonymized.


5. transmission of data to third parties

In order to fulfill your order, it may also be necessary to forward your data to third parties (e.g. opposing parties, substitutes, insurance companies, service providers we use and to whom we provide data, etc.) courts or authorities. Our commissioned data processors, i.e. IT service providers, providers of data management systems for attorney software including cloud solutions, process your data according to our specifications. Your data will be forwarded exclusively on the basis of the GDPR, in particular for the fulfillment of your order or on the basis of your prior consent.

Furthermore, we inform you that in the course of our legal representation and support, we regularly obtain factual and case-related information from third parties.

Some of the recipients of your personal data mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).

We strive to ensure that data breaches are identified at an early stage and, if necessary, reported to you or the relevant supervisory authority without delay, including the respective categories of data affected.

We will not retain data longer than is necessary to fulfill our contractual or legal obligations and to defend against any liability claims.
