The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the legal provisions (DSGVO, TKG 2003). In this data protection information, we inform you about the most important aspects of data processing within the scope of our website.
1. personal data
We, GERLACH Attorneys at Law (Dr. Roland Gerlach, Mag. Michaela Gerlach, independent attorneys at law) collect, process and use your personal data only with your consent or mandate or order for the purposes agreed with you or if there is another legal basis in accordance with the GDPR; this in compliance with the provisions of data protection and civil law.
We only collect personal data that is necessary for the performance and processing of our legal services or that you have voluntarily provided to us.
Personal data is all data that contains individual information about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photographs, voice recordings of persons, and biometric data such as fingerprints. Sensitive data, such as health data or data in connection with criminal proceedings, may also be included.
Data processing in the course of the mandate relationship also includes personal data of potential opponents, persons involved and persons providing information. Pursuant to Art. 14 (5) DSGVO, there is no obligation to inform this group of persons about the processing.
2. information and deletion
As a client (including contact person) or, more generally, as a data subject, you have the right at any time - subject to the lawyer's duty of confidentiality - to obtain information about your stored personal data, their origin and recipients and the purpose of the data processing, as well as the right to rectification, data transmission, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data.
If there are any changes to your personal data, please inform us accordingly.
You have the right at any time to revoke any consent given for the use of your personal data. Your request for information, cancellation, rectification, objection and/or data transfer, in the latter case, provided that it does not involve a disproportionate effort, may be addressed to the address of the Law Firm indicated in point 10 of this statement.
If you are of the opinion that the processing of your personal data by us violates applicable data protection law or that your data protection rights have been violated in some other way, you have the option of complaining to the competent supervisory authority. In Austria, the data protection authority is responsible for this.
3. data security
Your personal data is protected by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, illegal or even accidental access, processing, loss, use and manipulation.
Notwithstanding efforts to maintain a reasonably high level of due diligence at all times, it cannot be excluded that information you disclose to us via the Internet may be viewed and used by others.
Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacking attack on email account or telephone, interception of faxes).
4. use of the data
We will not process the data provided to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. This excludes the use for statistical purposes, provided that the data provided has been anonymized.
5. transmission of data to third parties
In order to fulfill your order, it may also be necessary to forward your data to third parties (e.g. opposing parties, substitutes, insurance companies, service providers we use and to whom we provide data, etc.) courts or authorities. Our commissioned data processors, i.e. IT service providers, providers of data management systems for attorney software including cloud solutions, process your data according to our specifications. Your data will be forwarded exclusively on the basis of the GDPR, in particular for the fulfillment of your order or on the basis of your prior consent.
Furthermore, we inform you that in the course of our legal representation and support, we regularly obtain factual and case-related information from third parties.
Some of the recipients of your personal data mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).
6. disclosure of data mishaps
We strive to ensure that data breaches are identified at an early stage and, if necessary, reported to you or the relevant supervisory authority without delay, including the respective categories of data affected.
7. storage of the data
We will not retain data longer than is necessary to fulfill our contractual or legal obligations and to defend against any liability claims.
8. website www.arbeitsrecht.at
The use of the website arbeitsrecht.at including access to the information published on it is generally possible without providing your personal data.
However, like most website operators, we collect, collate and store the following access data ("log files") provided by your internet provider in the course of your use of the website:
- IP address and IP location
- Referrer URL (the website visited before and the one visited afterwards)
- Number, duration and time of views (your interaction with the website)
- Search engines and keywords you used to find us
- Browser type, screen size and operating system.
This access data is collected automatically with the help of a website analysis tool. The storage of the collected access data only takes place in aggregated and therefore not individually assignable form. The collected access data is only used for statistical evaluations for the purpose of the operation, security and optimization of the website (predominantly legitimate interests pursuant to Article 6 para 1 lit f DSGVO).
Your personal data collected on the basis of your use of the website will not be disclosed to third parties, unless it is necessary for the fulfillment of legal obligations.
8.1 SSL encryption
This website uses SSL encryption for security reasons and to protect the transmission of confidential content, such as requests that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you transmit to us cannot be read by third parties.
This website uses "cookies" to make our offer more user-friendly, effective and secure.
A "cookie" is a small text file that we transfer to the browser's cookie file on your computer's hard drive via our web server. This enables our website to recognize you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our web pages. The content of the cookies we use is limited to an identification number that no longer allows any personal reference to the user. The main purpose of a cookie is to recognize visitors to the website.
This website uses one type of cookies:
- Session cookies: These are temporary cookies that remain in the cookie file of your browser until you leave our website and are automatically deleted at the end of your visit.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. When deactivating cookies, the functionality of this website may be limited.
8.3 Web analysis with Google Analytics
This website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.
Google Analytics uses so-called "cookies". These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by cookies about your use of this website is usually transmitted to a Google server in the USA and stored there.
We have activated the IP anonymization function on this website. This means that your IP address will be shortened by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.
Order data processing
We have concluded an order data processing contract with Google.
Demographic characteristics with Google Analytics
This website uses the "demographic characteristics" function of Google Analytics. This allows reports to be generated that contain statements about the age, gender and interests of site visitors. This data comes from interest-based advertising from Google as well as visitor data from third-party providers. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as shown in the item "Objection to data collection".
8.4 Google Maps
The website uses Google Maps for the display of map information on some pages. Google Maps is a map service provided by Google Inc ("Google"). Each time you access a page on this website that uses Google Maps, a direct connection is established between your browser and a Google server in the USA.
